TERMS & CONDITIONS

By using this website and/or purchasing any product or service from Salmon Fishing Adventures FZCO (“we”, “us”, or “our”), you agree to be legally bound by the Terms & Conditions set out below. If you do not agree to be bound, please do not use this site or complete any booking.

1. Definitions

• Client: The individual making the booking or purchasing a service.
• Service: Any guided fishing day, permit sale, consultation, or related offering.
• Booking Confirmation: A written email from us formally confirming your booking, the fishing venue & professional guide(s) involved.

2. Booking & Payment Terms

• All salmon fishing days, permits, or services are subject to availability and are not confirmed until you receive an official booking confirmation email.
• Full payment is required at the time of booking to secure your place. This is standard across the Scottish salmon fishing industry.

3. Cancellation & Refund Policy

• If you cancel your booking:
• A full refund (less card processing fees) will be issued only if the booking is re-let at full value.
• If re-let at a reduced rate, the shortfall will be deducted, and the balance refunded.
• If the booking is not re-let, all payments are forfeited.
• We strongly recommend you obtain adequate travel and cancellation insurance.

4. Service Amendments or Cancellations by Us

• We reserve the right to:
• Move the fishing location if conditions are unsafe or unfavourable.
• Substitute your originally confirmed guide with another qualified professional.
• Cancel a booking and offer a full refund or an alternative date in exceptional circumstances.

5. Conditions Beyond Our Control (Force Majeure)

We are not liable for disruptions or cancellations caused by factors including (but not limited to): adverse weather, flooding, drought, war, pandemics, travel restrictions, river closures, ghillie illness, equipment failure, fuel shortages, industrial action, terrorism, or any government-imposed measures.

6. Safety, Liability & Risk Acknowledgement

• All clients must wear a life jacket at all times near rivers, lochs, or lakes. We provide fully serviced life jackets as standard.
• Suitable eye protection must be worn while fishing or spectating.
• You participate in all fishing activities at your own risk. While we take all reasonable precautions, Salmon Fishing Adventures FZCO and any affiliated persons are not liable for personal injury, illness, or death, except where caused by our proven negligence.
• All ghillie and guide instructions must be followed. Failure to do so may result in removal from the river without refund.

7. Fishing Regulations

• All fishing is governed by Scottish river-specific conservation policies, updated annually by local fishery boards.
• Clients must adhere to local rules, catch limits, fishing methods, and licensing requirements.
• Regulations are available in the fishing hut or from your guide.

8. Arrival & Participation

• Clients must contact their ghillie or guide 48 hours before their booking to confirm participation.
• Please arrive at the fishing hut by 8:30am. Late arrivals must notify the ghillie or guide in advance.

9. River & Environmental Risk Awareness

Fishing in wild river environments carries inherent risks, including:

• Hazardous terrain (undercut banks, rabbit holes, damaged paths)
• Variable river conditions (floods, hidden currents, slippery boulders)
• Electric shock risk near overhead power lines (carbon rods conduct electricity)
• Weather hazards such as lightning and strong winds
• Accidental immersion – wear your life preserver outside your jacket and float feet-first downstream if swept away.

All guests must pay attention to safety briefings and demonstrate responsible behaviour at all times.

10. Chargeback Misuse Policy

By purchasing services from Salmon Fishing Adventures FZCO, you agree not to initiate a chargeback unless there is actual fraud or non-delivery of service except for conditions beyond our control as specified (but not restricted to) the above circumstances in clause 5 of these Terms & Conditions. Using a chargeback to avoid our refund policy or dispute a booking constitutes a breach of these Terms and may be considered fraudulent activity.

We reserve the right to:

• Submit full evidence to the payment provider to challenge the chargeback
• Pursue recovery of funds through legal means or debt collection

Disputes must be raised with us directly via jock@salmon-fishing-scotland.com before involving your card issuer.

11. Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the United Arab Emirates. Any disputes arising from use of this website or services shall be subject to the exclusive jurisdiction of the Dubai International Financial Centre (DIFC) unless otherwise agreed in writing.
